Fact Check: South Korea Files Lawsuit Against Israel For Genocide, War Crimes, And Crimes Against Humanity

It’s not the South Korean government who filed the lawsuit.

On June 24, news circulated that “South Korea has submitted lawsuits targeting Israeli officials,” including Prime Minister Benjamin Netanyahu, President Isaac Herzog, IOF Chief of Staff Herzi Halevi, Security Minister Yoav Gallant, Foreign Minister Israel Katz, Finance Minister Bezalel Smotrich, and Police Minister Itamar Ben-Gvir.

Netizens commended South Korea, praising the country for standing up against Israel. Since October, 37,668 Palestinians, many of which were women and children, have lost their lives due to Israeli attacks. Over 86K are injured, while many are starved, displaced, and lost their homes, families, and friends.

Yet, it’s not the South Korean government who has filed the “war crimes and crimes against humanity” lawsuit with the South Korean Police Investigation Agency against the Israeli officials. It’s South Korea’s People’s Solidarity for Participatory Democracy (PSPD), the Asian Dignity Initiatives (ADI)—NGOs (non-governmental organization), and more than 5,000 individuals, including two members of the National Assembly in Korea. They are reportedly demanding the seven officials’ “extradition to South Korea for investigation and prosecution under the country’s ‘Punishment for Crimes Under the Jurisdiction of the International Criminal Court Act.'” 

PSPD accuses the Israeli occupation officials of being involved in planning, ordering, and executing crimes against humanity, genocide, and war crimes. These allegations include attacks on humanitarian efforts and distinctive symbols, assaults on medical institutions and ambulances, the use of banned chemical weapons, and employing unlawful warfare tactics, such as starvation.

Now, the South Korean police must determine whether to refer this filed lawsuit to the district prosecutor.
